AGB – General Terms and Conditions of Business and Carriage

The prices in the current price list apply. We reserve the right to correct calculation and billing errors. Package deals are only valid for a specific order for a short period of time.


2.Orders

Orders are generally carried out in the manner in which they are ordered by telephone, in writing or by telex and confirmed in writing. The written order confirmation from ANT Transport GmbH is the only decisive factor for the acceptance of the contract (the scope of the contractually owed service). The customer undertakes to check the contents of the order confirmation carefully. Orders of any kind must clearly indicate the subject of the transaction. Changes, confirmations or repetitions must be marked as such. Verbal agreements require written (tele) confirmation.


3.Special features of the shuttle service

ANT Transport GmbH will confirm a customer's driving order with the order details, such as the pick-up date, location and time, by email. The pick-up time must be adhered to exactly, otherwise the right to transport is generally void (after a maximum of 15 minutes of waiting time for the ANT Transport GmbH driver) and is charged to the customer as so-called "waiting time". The customer must be reachable by telephone during the pick-up period (15 minutes before or after the agreed time), otherwise a timely pick-up may not be guaranteed. The pick-up is considered timely if it takes place within the pick-up period. If the pick-up by an ANT Transport GmbH driver does not take place within the agreed pick-up period, the customer must notify ANT Transport GmbH. When using the ANT Transport GmbH Airport Shuttle Service, the customer is generally picked up at the airport from the respective meeting point in the terminal. The customer is obliged to find the ANT Transport GmbH driver waiting at the meeting point, who is identified accordingly by a name tag or ANT Transport GmbH company logo. If flight or landing times have changed, ANT Transport GmbH will try to arrive on time. ANT Transport GmbH is aware of flight delays. ANT Transport GmbH reserves the right to charge an additional express fee of €15 gross for transport orders placed at short notice. Transport orders placed at short notice are defined as follows: orders on the same day and bookings after 6:00 p.m. for the following day. This fee may also be incurred for short-term rebookings/changes. We accept no liability for legal claims in the event of delays that are beyond our control. For the guest, this means that we are responsible for determining the pick-up time. If the guest requests a different pick-up time than that suggested by us, the risk is transferred to the guest. We transport our guests so that they arrive at the airport 2 hours before departure.


3.1 Waiting time

The free waiting time on the return journey is 30 minutes (arrival time according to order confirmation). After that, waiting time is charged. Waiting times can occur if a flight arrives at the airport early or late. If subsequent orders are already pending, these will be given priority and waiting times cannot be ruled out within reasonable limits. If the appointment is changed without consulting us, the passenger has no right to transport, reimbursement or reduction in costs.


4. Fare / commission

If cash payment has been agreed, the fare must be paid to the ANT Transport GmbH driver at the end of the order at the latest. If there is an order for a round trip, the entire fare must be paid to the ANT Transport GmbH driver at the end of the first trip. If invoicing has been agreed, the due date for payment is as specified. The invoice amount must be transferred to the ANT Transport GmbH account specified within 14 days, stating the invoice and customer number. If orders are carried out for the benefit of a third party, the corresponding order fee must be paid by the customer in case of doubt. In the event of default, default interest will be charged in accordance with the statutory provisions (Section 288 of the German Civil Code). If a debt collection agency is commissioned in the event of late payment, the customer must bear the resulting costs.


5. Luggage

A maximum of two normal-sized pieces of luggage may be carried per person. Additional pieces of luggage or bulky goods must be declared when placing the transport order, otherwise there is no right to transport these items. ANT Transport GmbH may charge additional costs for such pieces of luggage. The amount of the additional costs will be communicated on request.


6. Withdrawal / Cancellation Fees

The contracting parties have the right to cancel the transport order. Cancellations must be made in writing. The free cancellation of an airport shuttle service is only possible up to 3 hours before the start of the journey. If the customer does not take a journey (so-called "no show") or cancels the transport order within 3 hours before the start of the journey, ANT Transport GmbH reserves the right to invoice the customer for the full order volume or the full fare. The customer reserves the right to prove that no damage or significantly less damage has been caused than the order/fare compensation demanded by ANT Transport GmbH. Individual cancellation conditions remain unaffected. In the event of disruptions to the normal process due to force majeure (weather, traffic, breakdown), there is no right of recourse against us. In the event of a vehicle breakdown, we will continue to transport the passengers at our expense.


7. Prohibited Uses

Vehicles from ANT Transport GmbH may not be used a) for the transport of dangerous substances of any kind b) for the commission of crimes within the meaning of the German Criminal Code (§§ 1-9 StGB), even if these are only punishable under the law of the place where the crime was committed c) for journeys that go beyond the contractual use The customer is prohibited from assigning the ANT Transport GmbH driver to the uses listed under points a)-c).


8. Customer's Liability

a) The customer is liable for all damage to the vehicle and to the ANT Transport GmbH driver personally without limitation, i.e. intentionally or negligently.b) Furthermore, the customer is liable without limitation and personally for all damage caused by use for prohibited purposes.c) The statutory liability provisions remain unaffected.The customer bears the damage resulting from transmission errors, misunderstandings and errors in telephone, (tele)written or email communication with the customer or with third parties, provided that the damage was not the fault of ANT Transport GmbH.For security reasons, ANT Transport GmbH reserves the right to obtain confirmation for orders received by telephone, (tele)written or email.If telephone, (tele)written or email messages are confirmed in writing, the customer must immediately complain about any discrepancies between these messages and the written confirmation.


9. Liability of ANT Transport GmbH

ANT Transport GmbH is liable for all damage caused to the customer through negligence, i.e. intentional or negligent, provided that the damage is covered by the motor vehicle liability insurance taken out for the relevant car. In the event of delay, liability only applies in the event of gross negligence or intent. Ant Transport GmbH may commission third parties to carry out all of the business assigned to it in its own name, in whole or in part, if it considers this to be justified, also taking into account the interests of the customer. If ANT Transport GmbH makes use of this, responsibility is limited to the careful selection and instruction of the commissioned third party. No liability is accepted for the consequences of delays due to traffic congestion, traffic jams, force majeure and unforeseeable vehicle breakdown. ANT Transport GmbH is also not liable for theft of luggage by third parties.


10. Claims for damages

Claims for damages against ANT Transport GmbH are only due if they are free of objections and objections to the reason and the amount claimed. If claims for damages result from a traffic accident, a claim only exists if there was previously an opportunity to inspect the investigation file. For all other claims asserted against ANT Transport GmbH, ANT Transport GmbH will only pay on the basis of invoices that meet the general legal requirements. For indirect claims for damages, liability is limited to 8 times the net fare.


11.Subject to change

In principle, the vehicle ordered will be made available. If it is not possible to fulfill the order for internal company reasons or objective impossibility, ANT Transport GmbH reserves the right to provide another vehicle. ANT Transport GmbH will endeavor to keep the deviation from the ordered vehicle as small as possible with regard to the usual intended use and possible uses.


12.Data storage

The customer agrees that ANT ransport GmbH stores his personal data for company purposes.


13. Jurisdiction

For all disputes arising from or in connection with the contract or the contractual relationship, Munich is agreed as the place of jurisdiction if a) the customer is a registered trader in accordance with Section 1 of the German Commercial Code (HGB) b) he is a person equivalent to a registered trader in accordance with Section 38 Paragraph 1 of the German Code of Civil Procedure (ZPO) c) he has no general place of jurisdiction in Germany d) he has moved his place of residence or habitual abode abroad after conclusion of the contract e) his place of residence or habitual abode is unknown at the time the action is brought.
